Please read these Terms and Conditions (“Terms”) carefully before using www.andrewprod.com (the “Website”) or purchasing any products or services from Andrew Prod Photography.

These Terms form an agreement between you (“you” or “your”) and Andrew Prod Photography (“we”, “us” or “our”).

By using our Website or purchasing our products or services, you agree to these Terms. If you do not agree with these Terms, please do not use the Website or purchase our products or services.

1. About Us

Andrew Prod Photography provides professional photography services, educational content, online courses, digital products and related resources.

Our offerings may include photography sessions, commercial and creative photography services, online courses, tutorials, downloadable resources, workshops and other educational materials.

2. Using Our Website

You agree to use our Website lawfully and responsibly.

You must not:

  • Break any applicable law or regulation
  • Attempt to gain unauthorised access to our systems or accounts
  • Copy, reproduce or distribute our content without permission
  • Interfere with the operation or security of the Website
  • Use our content for commercial purposes without our written permission

You must be at least 18 years old to purchase our products or services unless a parent or legal guardian is purchasing on your behalf and applicable law allows it.

3. Photography Services

When booking a photography service, the specific details of the service, including the price, date, location, deliverables and any other agreed arrangements, will be confirmed at the time of booking.

A booking is not confirmed until any required booking fee, deposit or full payment has been received and the date has been confirmed by Andrew Prod Photography.

Cancellations and postponements

Photography booking terms, including cancellation, postponement and payment arrangements, will be set out in the relevant photography agreement or contract provided to the client.

Nothing in these Terms affects any statutory rights you may have.

4. Creative Direction and Photography

Photography is a creative service. We retain reasonable creative and artistic discretion over matters including:

  • Photography style
  • Composition
  • Locations
  • Poses and direction
  • Lighting
  • Image selection
  • Editing and retouching

We will make reasonable efforts to take account of your agreed brief and preferences but cannot guarantee that every requested photograph, pose, location, background or creative outcome will be possible.

Weather, location restrictions, availability of people or venues, technical circumstances and other factors outside our reasonable control may affect a shoot.

5. Delivery of Photographs

The expected delivery arrangements for photographs will be communicated at the time of booking.

Unless otherwise agreed, photographs will be supplied in the format and quantity specified as part of your booking or purchase.

Minor variations in colour, appearance or reproduction may occur due to differences between cameras, monitors, screens, printing processes and viewing conditions.

We recommend that you keep appropriate backup copies of any digital photographs supplied to you.

6. Storage of Photographs

Unless otherwise agreed in writing, we will retain photographs and related image files for up to 12 months from the date of delivery.

After this period, photographs and related files may be permanently deleted without further notice.

Clients are responsible for downloading, backing up and securely storing their photographs once they have been delivered. Andrew Prod Photography is not responsible for retaining or recovering photographs after the 12-month storage period.

Where a specific storage period or backup service is included as part of a photography package, the terms of that service will take precedence.

7. Online Courses and Digital Products

We may offer online courses, educational programmes, downloadable resources, tutorials and other digital products.

Course and digital-product content is provided for educational and informational purposes.

Access arrangements, course content, pricing and any included materials will be described on the relevant sales or checkout page.

Course content may be updated, improved or replaced from time to time.

Unless otherwise stated, purchasing a course gives you a personal, non-transferable right to access and use the course for your own educational purposes.

You must not:

  • Share your login details with another person
  • Copy, reproduce or redistribute course materials
  • Resell or commercially exploit course materials
  • Upload course materials to another website or platform
  • Make course materials publicly available
  • Reproduce substantial parts of the course without our written permission

8. Intellectual Property

Unless otherwise stated, all content made available through the Website and our products and services is owned by or licensed to Andrew Prod Photography.

This includes, but is not limited to:

  • Photographs
  • Videos
  • Course lessons
  • Written materials
  • Downloadable resources
  • Templates
  • Graphics
  • Logos
  • Website content
  • Educational materials

Purchasing a product or course does not transfer ownership or copyright to you.

You receive only the rights expressly granted to you under these Terms or the relevant purchase agreement.

Photography copyright

Unless otherwise agreed in writing, copyright in photographs created by Andrew Prod Photography remains with Andrew Prod Photography.

You may use photographs supplied to you according to the usage rights agreed as part of your booking or purchase.

You must not reproduce, sell, license, alter or commercially exploit photographs beyond the agreed usage rights without our written permission.

9. Payments

Prices for our products and services will be displayed on the Website or communicated to you before purchase.

Payment must be made using the payment method made available at the time of purchase.

Payments may be processed through third-party payment providers. We do not generally store your full payment card details.

Where a third-party payment provider is used, its own terms and privacy policy may also apply.

10. Refunds and Cancellations

For online courses and digital products, purchases are generally non-refundable once access has been provided.

However, if you are unhappy with your purchase, please contact us at info@andrewprod.com and we will consider refund requests on a case-by-case basis.

For photography services, cancellation and refund arrangements are set out in the relevant photography agreement or contract.

Nothing in these Terms affects your statutory rights.

11. Educational Information and Results

Our courses, resources and educational materials are designed to provide practical information and guidance based on our experience.

However, we do not guarantee that you will achieve any particular business, financial, creative, social-media, audience-growth or other result from using our products or courses.

Your results will depend on factors including your own experience, effort, circumstances and implementation.

Our educational content should not be treated as legal, financial, medical or other professional advice.

12. Third-Party Platforms and Services

We may use third-party platforms and service providers to operate our business, including platforms used for website hosting, payments, email marketing, course delivery, analytics, scheduling and other business functions.

For example, our online courses may be hosted and delivered through Systeme.io.

Your use of a third-party platform may also be subject to that provider’s own terms and policies.

We are not responsible for the independent operation, availability or policies of third-party platforms where those matters are outside our reasonable control.

13. Affiliate Links

From time to time, we may use affiliate links or recommend products and services provided by third parties.

Where we receive a commission or other benefit from an affiliate relationship, we will make this clear where appropriate.

We are not responsible for the products, services, websites or privacy practices of third parties.

14. Testimonials and Reviews

We may display testimonials, reviews or feedback from customers.

Where required, we will obtain appropriate permission before using identifiable information such as your name, photograph or other personal information for promotional purposes.

Our use of personal information is also subject to our Privacy Policy.

15. Website and Course Availability

We make reasonable efforts to keep our Website and online services available and functioning correctly.

However, we do not guarantee that the Website, course platform, digital products or any third-party service will always be available, uninterrupted or error-free.

We may temporarily suspend access where necessary for maintenance, security, updates or circumstances outside our reasonable control.

16. Limitation of Liability

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under UK law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to the above, we will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.

Nothing in these Terms affects your legal rights as a consumer.

17. Events Outside Our Control

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances outside our reasonable control.

This may include events such as serious illness, natural disasters, extreme weather, government restrictions, internet or technology failures, platform outages, strikes or other events that could not reasonably have been anticipated or prevented.

Where reasonably possible, we will communicate with you and take reasonable steps to minimise the impact.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, products, Website or legal requirements.

The latest version will always be published on the Website.

For purchases already made, changes to these Terms will not retrospectively remove rights you have already acquired or otherwise alter your statutory rights.

20. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you will also benefit from any mandatory protections provided by the law of the country in which you live that cannot legally be excluded.
